How Are THC Gummies Legal?
The legal landscape for THC products can be complex, but recent legislative changes have clarified their status in many areas in America. Here’s a look at how THC gummies have become a legal option for American consumers.
The 2018 Farm Bill and THC
The 2018 Farm Bill was a landmark piece of legislation that legalized hemp-derived products across the United States, provided they contain less than 0.3% THC by weight. This bill differentiated hemp from marijuana, allowing for the cultivation and commercialization of hemp and its derivatives, including hemp-derived THC gummies, under federal law. However, this legalization applies only to hemp-derived THC, not marijuana. But is there actually a difference?
Defining Hemp-Derived THC
Hemp-derived THC refers to THC that is extracted from hemp plants, which are legally defined as cannabis plants containing no more than 0.3% THC. We are able to legally produce and ship our THC gummies across the country because hemp-derived THC is legal as long as it remains below 0.3%. While that doesn’t sound like a lot of THC, it can be more than one might think.
How is 10mg of THC legal?
Our gummies weigh five grams each. If we multiply the weight of our gummy by the 0.3% threshold, this means that our gummies can legally include up to 15mg of hemp derived THC. With 10mg of THC in each of our THC gummies, we are well below the legal limit, and you can rest assured that you are not purchasing something that is federally illegal.
State Regulations Can Differ State-to-State
Despite federal legalization of hemp-derived THC, state regulations vary widely. Some states fully embrace THC gummies and other hemp-derived products, while others impose stricter rules or outright bans. This discrepancy means that while THC gummies might be legal in most states, they may be restricted or prohibited in a few. It's crucial for consumers to be aware of their local laws and regulations regarding THC products to avoid legal issues.
